Terms of Service

VisaScan AI does not decide, influence, predict, or affect visa outcomes in any way. Schengen visa decisions are made exclusively by the sovereign competent authorities of each Schengen member state — specifically the embassies, consulates, and designated visa processing centres.

Visa decisions are subject to the discretion of individual consular officers, each member state's national immigration policy, diplomatic considerations, the applicant's personal circumstances at the time of application or interview, and many other factors entirely outside VisaScan AI's knowledge, control, or influence.

The readiness score, missing document list, fix recommendations, and all other AI-generated outputs are:

• Advisory and informational only — they are not official assessments, consular determinations, legal opinions, or immigration decisions;
• Based on publicly available Schengen requirement data that we maintain editorially, which may not always reflect the most recent unpublished changes in individual consular practice or national policy;
• Generated by AI systems (Anthropic's Claude) that may occasionally produce incomplete, inaccurate, or outdated outputs despite our best efforts to maintain accurate underlying data;
• Not a substitute for advice from a qualified immigration solicitor, barrister, or accredited immigration adviser.

You must independently verify all requirements with the official website of the relevant embassy or consulate before submitting any visa application. The platform is a preparation aid. It is not a final authority and must not be treated as one.

Nothing on this platform — including checklists, AI reports, recommendations, emails, or any communication from VisaScan AI — constitutes immigration advice, legal advice, or any regulated professional service. No solicitor-client, adviser-client, or fiduciary relationship is created by your use of the platform.

We maintain and update country-specific overlays for all 29 Schengen member states. However, visa requirements can change without notice, and we cannot guarantee that our data is accurate, complete, or up to date at all times. Always check the official embassy website for the specific country you are applying to before submitting your application.

Where the platform uses phrases such as "embassy-aligned" or "rule-first," this describes our methodology of building requirement data from publicly available official sources, not a guarantee of accuracy or an endorsement by any embassy or government authority. Such phrases should be understood in the context of Sections 3.2 and 3.4 above.

You may use the platform to prepare Schengen visa documents for yourself and, where applicable, co-travellers in your immediate family or travel party. The Family Pack plan supports up to 4 travellers in a single review.

You must not use the platform:

• For any fraudulent, deceptive, or unlawful purpose, including creating, uploading, or relying on forged, altered, or fabricated documents in connection with any visa application;
• To upload documents belonging to other individuals without their explicit prior consent;
• To attempt to circumvent, hack, reverse-engineer, or undermine any security control, AI system, or technical infrastructure of the platform;
• To use automated bots, scripts, crawlers, or scraping tools to access or interact with the platform;
• To resell platform access or use it to provide commercial immigration consulting services to third parties without our prior written authorisation;
• To attempt to access another user's account, data, or documents;
• In violation of any applicable law.

Breach of Section 5.2 may result in immediate account suspension and may be reported to relevant authorities. Where suspension follows a proven breach, any paid-but-unused plan credit will be assessed on a case-by-case basis.

By uploading a document, you confirm that:

• You are the person named in, or the lawful owner or authorised custodian of, that document;
• You have the legal right to upload it for processing;
• The document is genuine, unaltered, and has not been forged or tampered with;
• Uploading it does not breach any applicable law or any obligation owed to a third party.

We will not process special category personal data (such as biographic data in your passport) without your separate, explicit consent. A distinct consent confirmation — separate from the upload action — will be presented at the point of upload. You may decline this consent; if you do, the document will not be processed. You may withdraw consent at any time by emailing support@visascan.ai.

VisaScan AI does not transmit, submit, or share your documents with any embassy, consulate, government body, or immigration authority. Documents are used only to generate your internal readiness report. The form auto-fill add-on produces a file that you download and submit yourself — we do not file anything on your behalf.

VisaScan AI operates entirely on a one-time payment model. There are no recurring charges, automatic renewals, or subscription fees of any kind.

All prices are displayed in USD unless otherwise stated. We reserve the right to change prices for future purchases. Pricing changes do not affect plans already purchased.

All payments are processed by Paddle.com Market Limited, our Merchant of Record. Paddle collects your payment, issues your receipt, and handles applicable taxes including EU VAT. We do not store your card details. By completing a purchase, you also agree to Paddle's applicable terms available at paddle.com.

If you have purchased any paid plan and no AI review has been initiated — meaning no documents have been submitted for AI analysis — you may request a full refund within 14 days of purchase by emailing support@visascan.ai with your order reference.

Once the AI review process has been initiated, the plan is considered consumed and a refund will not ordinarily be issued, subject to the following:

EU and EEA consumers: Under EU Directive 2011/83/EU, consumers have a statutory 14-day right to withdraw from distance contracts for digital services. This right may be disapplied where the consumer (a) expressly requests that performance begins before the withdrawal period ends, and (b) acknowledges that the right of withdrawal will be lost. Both confirmations are presented at the point of purchase. If you did not receive or complete this confirmation, please contact us and we will assess your request in accordance with your statutory rights.

All users: If the AI review was initiated but did not complete due to a technical error on our side, you are entitled to either a free re-run or a full refund at your election.

If a technical failure on our part prevents you from accessing a report or feature you have paid for, contact support@visascan.ai with your order reference. We will offer a free re-run or a full refund at your choice.

Email support@visascan.ai with: your registered email address, your order reference number, the plan purchased, and a brief description of your reason. We aim to respond within 5 business days and to resolve all refund requests within 10 business days.

To the fullest extent permitted by applicable law, VisaScan AI is not liable — in contract, tort, statute, or otherwise — for:

• Any visa rejection, denial, delay, cancellation, or adverse immigration outcome, regardless of whether such outcome follows your use of the platform or reliance on any report, score, or recommendation;
• Any loss of travel costs, flights, accommodation, event tickets, business opportunities, or other financial or personal loss arising from a visa refusal or processing delay;
• Any inaccuracy, incompleteness, or outdated status of checklist or country requirement data;
• Any decision by any embassy, consulate, border officer, or immigration authority.

To the maximum extent permitted by applicable law, VisaScan AI's total aggregate liability to you for all claims arising under or in connection with these Terms shall not exceed the greater of: (a) the total fees you paid to VisaScan AI for the specific plan or feature giving rise to the claim; or (b) USD $100.

We do not accept liability for indirect, incidental, special, consequential, or punitive loss — including loss of profits, business, revenue, or opportunity.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded by law, including:

• Liability for death or personal injury caused by our negligence;
• Liability for fraud or fraudulent misrepresentation;
• Any consumer protection rights under EU, UK, or other applicable mandatory law that cannot be waived by contract.

You may close your account at any time by emailing support@visascan.ai. On closure we will confirm closure in writing, delete your uploaded documents and profile data within 30 days, and retain only financial transaction records as required by law. You may request a copy of your data before closure.

We may suspend or terminate your account if:

• You have materially breached these Terms and, where the breach is capable of remedy, have failed to remedy it within 7 days of written notice from us;
• Immediate suspension is necessary to prevent fraud, ongoing harm to other users, or a security threat — in which case we may act without prior notice but will notify you promptly after;
• We are required to do so by applicable law or court order;
• Your account has been inactive for more than 24 consecutive months, following 30 days' advance email notice.

If your account is suspended or terminated and you believe this was done in error, you may appeal by emailing support@visascan.ai within 14 days of receiving notice of termination. We will review all appeals in good faith and respond within 10 business days. If the termination is found to have been made in error, we will reinstate your account and, where applicable, credit or refund any paid plan that was unused at the time of termination.

On termination, your access to the platform ceases immediately. Sections 3, 9, 10, 11, 14, and 15 survive termination.

These Terms are governed by the laws of the Republic of Azerbaijan, without regard to conflict of law principles.

Subject to Section 15.3, disputes arising under these Terms shall be subject to the jurisdiction of the courts of the Republic of Azerbaijan.

If you are a consumer habitually resident in the European Union or EEA, the choice of Azerbaijani law and jurisdiction in Sections 15.1 and 15.2 does not deprive you of the protection afforded by the mandatory provisions of the law of your country of residence, including but not limited to:

• Your right to bring legal proceedings before the courts of your country of habitual residence;
• Your rights under applicable EU consumer protection law, including EU Directive 2011/83/EU (Consumer Rights Directive) and Directive 93/13/EEC (Unfair Contract Terms);
• Your right to access the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

If you are a consumer in the United Kingdom, these Terms do not affect your rights under the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, or any other mandatory UK consumer protection legislation.

Before bringing any formal claim, please email support@visascan.ai with a description of the dispute and the outcome you are seeking. We commit to a substantive, good-faith response within 10 business days.
